Toestablish the Center for Doping and Medical Sport
underthe General Department of Sports and Physical Training,
Ministryof Culture, Sports and Tourism

THE PRIME MINISTER
Pursuantto the Law on Organization of Government dated December 25, 2001;
Pursuantto Decree No. 178/2007/ND-CP dated December 03, 2007 by the Government,defining the functions, tasks, powers, and organizational structure ofministries and ministerial-level agencies;
Pursuantto Decree No. 185/2007/ND-CP dated December 25, 2007 by the Government,defining the functions, tasks, powers, and organizational structure of theMinistry of Culture, Sports and Tourism;
At the request of the Minister ofCulture, Sports and Tourism,
DECIDES
Article 1: To establish the Center forDoping andMedical Sportunder theGeneral Department of Sports and Physical Training.
TheDoping and Sports Medicine Center is a state administrative unit, functioningin researching, testing, preventing doping in sports and physical training;diagnosing and treating diseases, rehabilitating for athletes and individualsparticipating in sports and physical training related to the use of doping.
TheCenter for Doping andMedical Sport, based in Hanoi, is entitled to legal status, seal andaccount in accordance with the laws.
Article 2: The Director of the GeneralDepartment of Sports and Physical Training defines specifically functions,tasks, powers, and organizational structure of the Center for Doping and SportsMedicine.
Article 3: This Decision takes effect fromthe date of its signing.
TheMinisters, the Heads of Ministerial-level agencies, the Heads of Governmentalagencies, and the Director of the General Department of Sports and PhysicalTraining are responsible for the implementation of this Decision./.

Pursuantto Decree No. 185/2007/ND-CP dated December 25, 2007 by the Government, definingfunctions, tasks, powers, and organizational structure of the Ministry ofCulture, Sports and Tourism;
Pursuantto Decision No. 66/2008/QD-TTg dated May 23, 2008 of the Prime Minister,defining functions, tasks, powers, and organizational structure of the GeneralDepartment of Sports and Physical Training of the Ministry of Culture, Sportsand Tourism;
Pursuantto Decision No. 2469/QD-TTg dated December 28, 2011 of the Prime Minister regardingthe establishment of the Center for Doping and Medical Sport under GeneralDepartment of Sports and Physical Training, the Ministry of Culture, Sports andTourism’s;
Atthe request of the Director of the Center for Doping and Medical Sport and ofthe Head of the Organization and Personnel Department,

Article1: Status and functions
TheCenter for Doping and Medical Sport is a state administrative unit under theGeneral Department of Sports and Physical Training, capable of doping research,test, and prevention in sports and physical training; providing medical exam, treatment,and rehabilitation for sportsmen and those participating in sport and physicaltraining activities related to the use of doping.
TheCenter for Doping and Medical Sport is entitled to legal status, seal andaccount in at the State Treasury and bank,
Article 2: Duties andpowers
1.To submit to the DirectorGeneral of the General Department of Sports and Physical Training thedevelopment planning of the long-term, 5-year, and annual programs of theCenter and to organize the due implementation upon approval.
2.To submit to the DirectorGeneral of the General Department ofSports and Physical Training the Anti-Doping plan and program; to implementanti-doping tasks preventing the use of doping in sport activities attournaments both domestic and international.
3.To advise leaders of theGeneral Department on the guide for the implementation of Anti-DopingRegulations; to study measures preventing the employment ofperformance-enhancing substances and prohibited methods in activities of sportand physical training.
4.To perform test and verifyresults of doping-test samples upon request; to archive doping-test samples andresults in activities of sport and physical training in accordance with the laws.
5.To provide medical exam, treatment,and rehabilitation for sportsmen and those participating in activities of sportand physical training in accordance with the laws.
6.To study application of scienceand technology in areas of doping prevention and control and medical sport; tostudy nutrition in sports; to test and evaluate the effects of drugs, foods,functional foods, and drinking water used in sport training and contest.
7.To form joint venture withorganizations and individuals both domestic and foreign in conductingscientific research, technology development, medical exam and treatment, andprofessional training in doping prevention/control and medical sport.
8.To inform, educate and raiseawareness regarding prevention and control of performance-enhancing drugs and prohibitedmethods in activities of sport and physical training.
9.To provide services conforming toduties and functions vested in accordance with the law.
10.To organize the management ofthe apparatus, human resources and documentations; implementing the policiesand entitlements for officials, officers and employers under the scope ofmanagement as delegated by the Director General of the General Department ofPhysical Training and Sports in accordance with the law.
11.To manage and use finances,assets and other incomes in accordance with the law.
12.To perform other tasksassigned by the Director General of the General Department of Physical Trainingand Sports.

Article 4: EffectiveImplementation
ThisDecision takes effect upon the date of signing.
Article 5: ImplementationResponsibility
TheDirector of the Center for Doping and Medical Sport, the Chief of Staff, theHead of the Personnel Department, the Head of the Finance Department, heads ofother Departments, agencies of the General Department of Physical Training andSports, and relevant organizations and individuals are responsible for the implementationof this Decision./.
